The attorney who claims to represent troubled pop star Britney Spears in the legal wrangling over control of her affairs vowed on Wednesday to continue his fight, one day after a federal judge ruled he is not the singer’s lawyer.

Attorney Jon Eardley has said he was hired by Spears on February 12, but a California court had previously appointed conservators to control her personal and business affairs and another attorney to represent Spears.

District Judge Philip Gutierrez on Tuesday ruled the state court’s appointment of the attorney precluded Eardley from acting as Spears’ lawyer.

Spears was hospitalized twice in January for psychiatric evaluation, and the California state court’s ruling occurred while she was not in court.

Eardley claims the state court violated Spears’ civil rights by appointing conservators because she was not present. He further argues that her conservators are not acting in her best interest.

“We have only just begun the fight,” Eardley said in a statement. “There is nothing that will stop me from dismantling, if necessary, this oppressive and unjust conservatorship.”

Spears, 26, has seen her life spin out of control since her breakup with ex-husband Kevin Federline. She has lost custody and visitation rights to their two sons, spent time in rehab and in recent months the Louisiana native has been seen around Los Angeles wearing pink wigs and talking in a British accent.

On February 1, a California court gave the singer’s father, Jamie Spears, control over her personal and business affairs through what is known as a conservatorship. An attorney, Andrew Wallet, was named co-conservator, and another lawyer, Samuel Ingham was appointed counsel for Britney.

That conservatorship has been extended on two occasions, and remains in effect until March 10.

More Mommy Time for Britney

After not seeing her boys for almost two months, Britney Spears has scored her second face-to-face visit in the past three days.

The embattled pop star received another in-home visit from one-year-old Jayden James and two-year-old Sean Preston on Monday, E! News has confirmed.

The kids were again shuttled to Spears’ home in Kevin Federline’s gray Dodge Viper truck, driven by Federline’s longtime security guard, at around 9 a.m. They departed shortly after noon.  News of the Monday sojourn was first reported by jfxonline.com.

While few details of Monday’s mommy-and-me session were available, during Saturday’s visit, Spears, 26, was not permitted to be alone with her sons.

Among those present at the initial visit were her father, Jamie Spears, a court-appointed monitor, a Federline bodyguard and an attorney from the Luce Forward law firm, which is handling Britney’s conservatorship for Jamie Spears. It was believed all parties were on hand again for Monday’s visit.

The boys have resided primarily with Federline, since October, when Spears was stripped of custody. The singer lost visitation on Jan. 3, after a custody standoff that ended with her being hospitalized and placed on a psych hold.

The recent visits were the result of negotiations between lawyers for Kevin Federline and Luce Forward last week, with Jamie Spears also sharing a large portion of the credit.

“None of this would have happened if Jamie Spears had not been involved. That’s for sure,” Federline attorney Mark Vincent Kaplan told E! News Friday. “He gets a lot of credit for helping make this happen. But we’ve worked very hard with the conservator lawyers, as well, to make this all work.”

Meanwhile, lawyers for the conservatorship filed new court documents Monday, urging a judge to end a civil rights challenge to Jamie Spears’ control over his daughter’s financial affairs.

Attorney Jon Eardley, who claims he was hired by the troubled singer earlier this month, has argued in court documents that Britney’s constitutional rights are being violated and is seeking to have her conservatorship case moved from Los Angeles Superior Court to federal court.

In their latest motion, the conservatorship attorneys argue that Eardley has both failed to prove that he legitimately represents Britney, and to meet the court’s filing deadline.

They have asked that the case be immediately returned to Los Angeles Superior Court Commissioner Reva Goetz and that Eardley be forced to reimburse the approximately $43,000 in attorney fees racked up as a result of his actions.

Britney Spears’ ex-husband Kevin Federline has agreed to reinstate her visitation rights with their two sons, his lawyer said in a statement on Friday, according to The Associated Press.

Federline’s attorney, Mark Vincent Kaplan, said in a statement the former couple has agreed to a modification of a court order that had stripped Spears of her visitation rights, AP reported. The statement did not provide more details, but Kaplan told People.com on Friday that Spears would be allowed to see her sons “soon, very soon.”

but only if the singer’s mom, Lynne gives the go-ahead first, it has been revealed.

Britney’s mom is currently looking after Sean Preston, two, and one-year-old Jayden James, while Federline  attends New York Fashion Week with the likes of P Diddy.

A source said: “K-Fed and Lynne get on really well. He hopes Lynne can bring Britney round to see sense so that she can have some face time with her kids.

“He knows however dazed and confused Brit gets, she’ll always love those two kids with all her heart.”

Meawhile, the Toxic singer’s dad has been given the power to sack the star’s manager.

A Los Angeles court granted Jamie Spears’ request to fire Britney’s business manager Howard Grossman during a hearing on Thursday, in which he requested additional powers over his troubled daughters affairs.

Jamie Spears took control of Britney’s money and assets after his daughter was committed into a psychiatric ward at the UCLA Medical Center in Los Angeles last week.

Britney’s parents reportedly dislike Grossman because of his close-relationship with the star’s self-proclaimed manager Sam Lutfi, who they claim drugged their daughter.

Documents released Friday show Grossman was served with the legal documents on Thursday afternoon.

In the papers Los Angeles Superior Court commissioner Reva Goetz ordered Howard Grossman to ‘turn over all documents, records and assets relating to Britney Spears.’

The order came after Goetz held an emergency closed-door hearing brought by Jamie Spears and lawyer Andrew Wallet, who is part of Britney’s conservatorship.

Under the powers of the conservatorship order, Jamie Spears is able to restrict the visitors Britney receives and has the right to approve contracts.

Spears parents hope the measures approved by the court will allow them to calm the craziness that has surrounded the pop star.

Britney discharged herself from the UCLA Medical Center in Los Angeles on Wednesday February 6 after doctors ruled she did not pose a danger to herself or to others.

After leaving she was pursued by crowds of paparazzi and television helicopters on a wild chase around Los Angeles before meeting up with her British pap boyfriend Adnan Galib.

The decision by doctors to let Britney leave the mental health facility infuriated the star’s parents.

In a statement they said: “As parents of an adult child in the throws of a mental health crisis, we were extremely disappointed this morning to learn that over the recommendation of her treating psychiatrist, our daughter Britney was released from the hospital that could best care for her and keep her safe.

“We are deeply concerned about our daughter’s safety and vulnerability and we believe her life is presently at risk.”

“There are conservatorship orders in place created to protect our daughter that are being blatantly disregarded.

“We ask only that the court’s orders be enforced so that a tragedy may be averted.”

A Superior Court commissioner gave Britney Spears’ father the power to fire the singer’s business manager, according to documents released Friday.

Commissioner Reva Goetz also ordered Howard Grossman to turn over “all documents, records and assets relating to Britney Spears” to James Spears, who is the court-appointed conservator of his daughter and her estate.

The order came the day after Goetz held an emergency closed-door hearing on a motion brought by the singer’s father and lawyer Andrew Wallet, who is part of the conservatorship.

Spears’ parents said they feared their daughter’s life was at risk after she was released from a hospital psychiatric ward on Wednesday.
